A U.S. federal court has granted InMode a default judgment against DHGate sellers for trademark infringement and counterfeit sales involving Morpheus8 devices.
The U.S. District Court for the Central District of California has issued a default judgment in favor of InMode Ltd, awarding the company a permanent injunction and monetary damages against DHGate sellers who promoted and sold counterfeit versions of its medical devices.
Legal Ruling Addresses Trademark Infringement
InMode’s legal action cited trademark infringement, false designation of origin, and unfair competition under California law. The court ruled in favor of the company on all claims. The judgment includes a permanent injunction barring the defendants from using InMode’s trademarks—including MORPHEUS and INMODE—and orders the removal of counterfeit product listings and the freezing of related assets.
“InMode maintains a zero-tolerance policy towards fraudulent business practices including counterfeit goods and for any platforms or sellers who are using, selling, or distributing false products,” said Moshe Mizrahy, CEO of InMode. “We are committed to public safety and will continue to protect consumers from potential harm caused by unauthorized Morpheus8 devices.”
Verified Provider Program Supports Authentic Use
InMode has launched a Verified Provider Program to help consumers identify clinics using genuine Morpheus8 technology. The program allows certified practices to verify their status publicly, aiming to protect patient safety and maintain brand integrity in the face of counterfeit sales.
